TERMS AND CONDITIONS
Mr M C D Gribbin & Mrs JJ Barwell trading in partnership as Higher Ash Farm, “Property Owners”. Clients applying to book a property are referred to as “the Tenants”. When booking all of the names of the people “ Tenants” staying at the property must be included on the booking form. When you book the contract is between the Tenants and the Owners. The Owners are responsible for providing the accommodation in a clean, safe and appropriate standard. The Lead Tenant must be over 18yrs of age.
Size & Party:
Unless agreed prior to arrival by the owners, no group bookings of four or more adult members under the age of 25 are accepted. The owners or their representative reserve the right to refuse access to the property without compensation where no agreement has been made in advance. The Tenants rights may be forfeited without compensation, or an additional charge may be made where: More guests arrive than are specified on the booking form/ or the number the property holds, attempt to take up occupation, overnight guests without the owners express permission, any activity is undertaken which may cause unreasonable damage, noise or disturbance.
The Tenancy confers upon the Tenants the right to occupy for a holiday within the meaning of schedule 1, Paragraph 9 of the Housing Act 1988. The Tenants agree: (a) To pay for any losses or damage to the property however caused (reasonable wear and tear excepted). (b) To take good care of the property and leave it in a clean and tidy condition at the end of the tenancy. (c) To permit the Owners or their Representative reasonable access to the property. (d) Not to part with possession of the property or share it except with members of the party as shown on the booking form. In no circumstances may the number of people exceed the stipulated description. A cot may only be occupied by a child aged 24 months or less. (e) Not to cause an annoyance or become a nuisance to occupants of adjoining premises. (f) Not to use the property for any commercial purposes. In the event of breach of these terms and conditions the Tenants may be required to leave the property during the period of the booking without compensation. (g) Where additional facilities such as a telephone or broadband are provided the Tenants agree not to make unreasonable use of these facilities. Tenants agree that where use is deemed as unreasonable by the Owner or the Representative, this will be invoiced to them on departure as Damage to Property.
Booking confirmation will be sent to the lead Tenant when the deposit/ payment in full “if booking under six weeks before a stay” has been received along with a statement agreeing to our terms and conditions and all the details of Tenants.
Authority to Sign:
The person making the booking certifies that he or she is authorised to agree the terms and conditions on behalf of all persons included in the party. He or She agrees to take responsibility for the party occupying the property. When making your booking we will ask you to write in an email/letter you have read and agreed to our terms and conditions before we proceed with your booking. .
Any booking made less than six weeks before a tenancy is due to commence must be paid in full with a £250 refundable security deposit
Any booking made six weeks or more before a tenancy is due to start is required to pay 33% of the rental as a deposit. The balance of the tenancy is then due with a £250 refundable security deposit 6 weeks before the tenancy is due to commence.
The security deposits are refunded within 72 hours of departure ”into a nominated bank account”, providing the property, furnishings and effects are returned in the same condition as they were at the start of the rental. We will ask you two weeks before your stay for the details of the account you would like the money to be deposited into.
When the Owner sends the booking confirmation, the tenant is then liable for the balance outstanding and the security deposit. All payments are non refundable.
Payment can be made directly into our bank account or made by cheque. Bank account details will be provided when a reservation in made. When making a cheque payment the booking confirmation will be sent when we have received the cheque and it has cleared.
Any amendments to booking confirmations maybe subject to a £25 charge.
In the event of a cancellation the deposit and any payments in full are not refundable. The tenant remains responsible for the outstanding balance six weeks prior to the tenancy commencing.
The Owners will however endeavour to find an alternative tenant. Where a new Tenant is found we will refund the cost of you stay minus a £75 administration cost on the departure date of your stay on the booking confirmation.
Arrival & Departure times
The property/properties are available from 4pm on the arrival date and must be vacated by 10am on the departure date stated on the booking confirmation. After 10am the tenancy has ended and our cleaning/ caretaker team are entitled to access properties to carry out work in preparation for the next Tenants
We allow one well-behaved small/medium dog. Two dogs by negotiation. We charge £25.00 per dog. Dogs are not allowed upstairs or on the furniture.
All our properties are strictly non-smoking and any damage incurred as the result of someone smoking will be charged.
Internet access/ WIFI
The Owners provide WIFI Internet access. This is only suitable for browsing and checking emails, as we have a very slow Internet connection. We cannot guarantee WIFI coverage in all the rooms of the Property during your stay.
Each barn has two designated spaces for parking.
All bed linen is included in the price and beds will be made up as specified in the booking confirmation. During a two-week stay we do like to provide a change of linen & towels. We can arrange for our housekeeping staff to change this for you or provide the linen/ towels for you to change it yourself.
Each tenant is provided with a hand towel and bath sheet. These are not to be taken to the beach. We also ask for tenants to be especially careful not to get sun cream/ face creams/ make up etc. on towels or bedding as you will be liable for any damage as a result of this.
Condition of Property/ Inventory
Before your arrival the property will be cleaned and inventory checked. Any damage or discrepancies must be reported within 24 hours of arrival. Otherwise it will be deemed everything is in order and the accommodation is satisfactory. Any losses, damage or cleaning which is deemed above an acceptable standard is chargeable. The Owner will notify the Tenant of this within 72 hours of departure and raise any invoice before refunding the security deposit. Leave the property in the same condition as it was found.
Damage to Property
In the event of any damage/losses above the security deposit £250 allowance the Tenant is liable by accepting our terms and conditions to pay in full the balance of any damage caused. This will be invoiced and evidence documented and supplied to the Tenant within 48 hours of departure.
All electricity, oil and water costs are included in the price of your stay. The accommodation has a log burner and a full basket of logs will be present on arrival. If you burn a full basket of logs you are liable for a £30 charge and half a basket is £15.00. If payment is not made for logs on departure by agreeing to our terms and conditions you have allowed us to recover this money from the security deposit. We will notify the tenant of the situation prior to withdrawing the required amount to settle the arrears.
Photographs of the interiors of properties are representative only and interiors may vary. Changes to external premises or facilities described in our advertising or changes to availability of properties are outside of our control and cannot be relied upon absolutely. The owners take no responsibility for noise or nuisance resulting from third party activity over which they have no control. Tenants are responsible for ensuring the property is suitable for their needs prior to booking.
The Owners do not accept liability for any accident, damage, loss, injury, expense, or inconvenience whether to person or property, which the Tenants or anyone connected with the letting may incur. The Owners reserve the right to provide alternative accommodation or cancel owing to unforeseen circumstances beyond our control. If for any reason beyond the owners control the property is not available on the date booked (owing to fire damage for example) or the Owners feel it is deemed unsuitable for holiday letting, all rent and charges paid in advance to the owner will be refunded in full. The Tenants shall have no further claim against the Owners. Disclaimer: The properties are used at your own risk. Special care must be taken where there are balconies, raised terraces, ponds, streams and farm animals. Parents should ensure their children are supervised in such areas at all times.
Governing Law & Jurisdiction:
The contract is deemed to have been made at Higher Ash Farm, Ash, Dartmouth, Devon, TQ6 0LR. English Law shall govern the validity, construction and performance of this agreement. The tenants submit to the exclusive jurisdiction of the English Courts.
All complaints must be notified to the Owner or their Representative immediately to ensure sufficient time is given to investigate and/ or take the necessary remedial action. Any problems that are apparent to you on arrival at the property must be reported within 24 hours of arrival. Compensation will not be offered where the Tenant has denied the Owners or the Representative the opportunity to rectify matters during the holiday.
These Terms and Conditions are correct as of 26/10/2015. They may be amended at any time without prior warning.
